Man kan ikke blot bruge en dansk model til en aftale, da forholdene i USA er helt anderledes end i Danmark.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ans\u00e6ttelsen skal ske via et amerikansk selskab. Dette selskab skal registreres i den stat, hvor medarbejderen skal arbejde (ogs\u00e5 hvis det prim\u00e6rt er arbejde hjemmefra). Derudover skal dert foretages en r\u00e6kke forskellige registreringer som arbejdsgiver i staten. Det er vigtigt, at der udarbejdes en amerikansk ans\u00e6ttelsesaftale, som er lavet specifikt til den stat, hvor ans\u00e6ttelsen er. Hver stat har egne regler p\u00e5 dette omr\u00e5de. Inden for ans\u00e6ttelsesretten er der flere regler, som er ufravigelige, og som vil g\u00e6lde ved ans\u00e6ttelser inden for den p\u00e5g\u00e6ldende stat. Dette sikrer en h\u00f8j grad af fleksibilitet for arbejdsgiveren. Der kan v\u00e6re et kort ans\u00e6ttelsesbrev og afh\u00e6ngigt af stillingen, s\u00e5 laves der nogle gange en s\u00e6rskilt aftale om fortrolighed, ejerskab til IP og evt. konkurrenceklausuler. Mange af de generelle vilk\u00e5r, som er ens for alle medarbejdere, kan ogs\u00e5 fremg\u00e5 af en medarbejderh\u00e5ndbog.<\/span><\/p>\n<p>[\/dipl_tabs_item][dipl_tabs_item title=&#8221;Opsigelse &#8211; At-will Employment&#8221; _builder_version=&#8221;4.21.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3 class=\"et_pb_module_header\">Opsigelse &#8211; At-will Employment<\/h3>\n<div class=\"et_pb_blurb_description\">\n<p><span style=\"font-weight: 400;\">Ans\u00e6ttelser i USA er som udgangspunkt \u201cat-will\u201d. Det betyder, at en arbejdsgiver kan opsige en medarbejder uden varsel og uden saglig grund, s\u00e5 l\u00e6nge opsigelsen ikke baserer sig p\u00e5 ulovlige grunde som fx diskrimination. Det betyder ogs\u00e5, at en stilling og arbejdsomr\u00e5der kan \u00e6ndre karakter efter behov fra tid til anden.<\/span><\/p>\n<\/div>\n<p>[\/dipl_tabs_item][dipl_tabs_item title=&#8221;Ferie&#8221; _builder_version=&#8221;4.21.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3 class=\"et_pb_module_header\">Ferie<\/h3>\n<div class=\"et_pb_blurb_description\">\n<p><span style=\"font-weight: 400;\">Loven dikterer ikke regler om garanteret ferie. Feriens l\u00e6ngde aftaler man i ans\u00e6ttelsesaftalen, eller den kan fremg\u00e5 af en medarbejderh\u00e5ndbog. Det er ikke us\u00e6dvanligt, at der aftales ca. 3-4 uger om \u00e5ret.<\/span><\/p>\n<\/div>\n<p>[\/dipl_tabs_item][dipl_tabs_item title=&#8221;Sygedage&#8221; _builder_version=&#8221;4.21.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3 class=\"et_pb_module_header\">Sygedage<\/h3>\n<div class=\"et_pb_blurb_description\">\n<p><span style=\"font-weight: 400;\">Staterne og visse store byer er i stigende grad begyndt at regulere retten til betalte sygedage. Dette vilk\u00e5r er derfor altid et, som skal unders\u00f8ges konkret fra stat til stat og nogle gange fra by til by. Afh\u00e6ngigt af en r\u00e6kke forhold, som altid skal vurderes konkret, kan det nogle gange v\u00e6re lettere at sl\u00e5 ferie og sygedage sammen i \u201cPTO\u201d, som st\u00e5r for paid time off. PTO-dage kan bruges p\u00e5 enten ferie eller sygdom.<\/span><\/p>\n<\/div>\n<p>[\/dipl_tabs_item][dipl_tabs_item title=&#8221;Health Insurance&#8221; _builder_version=&#8221;4.21.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3 class=\"et_pb_module_header\">Health Insurance<\/h3>\n<div class=\"et_pb_blurb_description\">\n<p><span style=\"font-weight: 400;\">I USA er det almindeligt, at arbejdsgivere tilbyder health insurance til medarbejderne. Det er s\u00e5dan, at sundhedssystemet er opbygget i USA. Ans\u00e6ttelsesaftalen vil typisk kort og p\u00e5 generelt niveau henvise til, at der kan v\u00e6re health insurance, som arbejdsgiver tilbyder. Det er ikke almindeligt, at ans\u00e6ttelsesaftalen specificerer, hvad vilk\u00e5rene er eller andet specifikt.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Vilk\u00e5rene for health insurance er de samme, som skal tilbydes til alle ansatte, og forsikringsselskabet kan \u00e6ndre vilk\u00e5rene og policen fra \u00e5r til \u00e5r. Desuden skal arbejdsgiver ogs\u00e5 kunne \u00e6ndre p\u00e5 vilk\u00e5rene fra \u00e5r til \u00e5r.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Det er almindeligt, at de ansatte betaler en del af pr\u00e6mien til health insurance, som tr\u00e6kkes over l\u00f8nnen.<\/span><\/p>\n<\/div>\n<p>[\/dipl_tabs_item][dipl_tabs_item title=&#8221;Pension &#8211; 401(k)&#8221; _builder_version=&#8221;4.21.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3 class=\"et_pb_module_header\">Pension &#8211; 401(k)<\/h3>\n<div class=\"et_pb_blurb_description\">\n<p><span style=\"font-weight: 400;\">Mange arbejdsgivere tilbyder at betale til pension (i USA kaldes private pensioner \u201cretirement\u201d). Der er forskellige ordninger. En popul\u00e6r ordning hedder 401(k). Det henviser blot til paragraffen i loven, som regulerer disse pensioner.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ligesom for health insurance vil ans\u00e6ttelseskontrakten kun ganske overordnet henvise til, at der kan tilbydes pension. De konkrete vilk\u00e5r beskrives ikke, og man plejer heller ikke at beskrive, hvor meget der indbetales fra arbejdsgiver. Disse vilk\u00e5r kan \u00e6ndres, og der henvises blot til vilk\u00e5rene, som pensionsselskabet udbyder.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Det er almindeligt, at arbejdsgiver tilbyder at matche op til en vis procent af den samlede l\u00f8nudbetaling.
